These terms and conditions outline the rules and regulations for the use of Act Now Button LLC's Website, located at https://www.actnowbutton.com.
By accessing this website we assume you accept these terms and conditions. Do not continue to use Act Now Button if you do not agree to take all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of Canada. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Platform Overview
Act Now Button LLC ("Act Now") is a campaign infrastructure platform that connects creators, charities, and sponsors to drive measurable, verified impact. Act Now provides attribution and verification services. Act Now does not hold, pool, or redirect funds. All payments are processed directly by Stripe.
Cookies
We employ the use of cookies. By accessing Act Now Button, you agreed to use cookies in agreement with the Act Now Button LLC's Privacy Policy.
Most interactive websites use cookies to let us retrieve the user's details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.
License
Unless otherwise stated, Act Now Button LLC and/or its licensors own the intellectual property rights for all material on Act Now Button. All intellectual property rights are reserved. You may access this from Act Now Button for your own personal use subjected to restrictions set in these terms and conditions.
You must not:
- Republish material from Act Now Button
- Sell, rent or sub-license material from Act Now Button
- Reproduce, duplicate or copy material from Act Now Button
- Redistribute content from Act Now Button
This Agreement shall begin on the date hereof.
Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. Act Now Button LLC does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of Act Now Button LLC, its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, Act Now Button LLC shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.
Act Now Button LLC reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.
You warrant and represent that:
- You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;
- The Comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party;
- The Comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy
- The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.
You hereby grant Act Now Button LLC a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media.
Sponsor Terms
Funding Commitment
By authorizing a funding commitment on Act Now, you ("Sponsor") agree to the following:
- Payment Method: You must add a valid payment method to activate funding. No upfront charge is taken.
- First Charge: Your first charge occurs when $10 CAD of verified actions accrue, plus the applicable platform fee. This validates your payment method and establishes billing.
- Ongoing Billing: After your first successful charge, billing triggers when the accrued amount reaches $100 CAD or every 7 days, whichever occurs first. Each charge equals verified action amounts plus the applicable platform fee.
- Budget Limit: You set a budget limit. You will never be charged beyond this amount. You are notified at 80% and 100% utilization.
- Charge Finality: Once processed, charges are final. Charges are separate from supporter donations and not contingent on the permanence of any donation.
- Billing Failure: If a charge fails, the campaign is paused immediately. You have 48 hours to update your payment method. If payment is not resolved within 48 hours, or if three consecutive charges fail, the campaign may accept funding from other sponsors.
- Budget Exhaustion: When your budget limit is reached, your funding pauses. The campaign charity controls whether you receive a top-up notification. The campaign may accept funding from other sponsors.
- Classification: Sponsor funding is a marketing expenditure for campaign performance and attribution services. It is not a charitable gift. The platform fee is a marketing infrastructure fee — not a commission on charitable donations.
Sponsor Controls and Limitations
- You may set budget limits, eligible action types, and invite-only restrictions.
- You may request creator removal by submitting evidence to the campaign charity.
- You do not control campaign messaging, verification rules, or creator approval (except in invite-only mode).
Budget Limit Overflow
When verified actions exceed your budget limit, allocation stops at your limit on a first-come-first-served basis. The campaign may continue organically. You will be notified at 80% and 100% of budget utilization with the option to increase your funding.
Creator Terms
Creator Obligations
By creating a Creator Page and participating in campaigns on Act Now, you ("Creator") agree to the following:
- Attribution Tracking: You accept that all actions driven through your attribution links are tracked and recorded for verification and compensation purposes.
- Disclosure Requirements: You must include sponsor-backed campaign disclosure before your audience takes action, in the same medium as your promotional content. Pre-built disclosure text is provided by Act Now and must be used or adapted in compliance with applicable advertising standards.
- Truthful Representation: You must not misrepresent your affiliation with any charity, overstate campaign outcomes, or make misleading claims about donations or impact.
- Content Standards: Your promotional content must not contain illegal content, hate speech, harassment, threats, or content that could reasonably harm the reputation of the campaign charity or associated sponsors.
Compensation
- Creator compensation is paid for driving verified actions attributed through your Creator Page.
- Compensation is a performance payment for marketing services, not a charitable gift.
- Compensation amounts are determined by the sponsor's per-action rate and your attributed verified action count.
Tax Reporting
Creator compensation is taxable income. You are responsible for reporting this income and paying applicable taxes. For Canadian creators: Act Now will issue T4A information slips for total compensation of $500 or more per calendar year, as required by the Canada Revenue Agency. You must provide a valid Social Insurance Number (SIN) or Business Number during account setup.
Terms Violations and Compensation Forfeiture
The following violations will result in forfeiture of all pending and future compensation, removal from the affected campaign(s), and potential platform ban:
- Illegal activity conducted through or promoted via the platform.
- Content that is harmful, harassing, threatening, or defamatory.
- Hacking, manipulation, or exploitation of platform systems.
- Coordinated fraud (e.g., generating fake actions, coordinated chargebacks).
- Failure to comply with disclosure requirements after notice.
- Misrepresentation of charity affiliation or campaign outcomes.
Pre-removal verified actions: If you are removed from a campaign by a charity (not for terms violations), verified actions attributed to you before the removal date remain valid and compensated. If you are removed for terms violations, all pending compensation is voided.
Payout Terms
Compensation accumulates in your Stripe Connect account and is disbursed weekly on Fridays when your balance reaches $10 CAD. You may request a manual payout at any time if your balance is $10 CAD or more.
If you close your account:
- Balance of $5 or more: receive a final payout, donate to a campaign charity, or forfeit.
- Balance under $5: donate to a campaign charity or forfeit.
You may keep your account open until the payout threshold is reached.
Compensation is paid only for verified actions that have been successfully billed to a sponsor. Actions occurring when no sponsor funding is active ("unfunded actions") are tracked for attribution purposes but do not generate compensation.
Charity Terms
Charity Obligations
By onboarding as a charity on Act Now, you ("Charity") agree to the following:
- Stripe Onboarding: You must connect and maintain a valid Stripe account to receive supporter donations.
- Legal Registration: You must be a legally registered charitable organization in your jurisdiction.
- Tax Receipts: You are solely responsible for issuing tax receipts to supporters where applicable.
- Creator Management: You are responsible for approving, managing, and removing creators from your campaigns. You may delegate terms-violation enforcement to Act Now.
- Chargeback Responsibility: Supporter donation chargebacks are processed through your Stripe account. Act Now has no financial responsibility for donation chargebacks.
- Direction and Control: You retain direction and control over your fundraising campaigns in compliance with CRA requirements.
- Third-Party Agreement:A written third-party agreement between you and Act Now is required before campaign activation. This agreement documents the charity's direction and control over fundraising activities conducted through the platform.
Chargeback and Reversal Policy
Donation Chargebacks
Donations flow directly from supporters to the charity's Stripe account. Chargebacks on donations are disputes between the supporter and the charity, processed through the charity's Stripe account. Act Now has no financial exposure to, or responsibility for, donation chargebacks.
Sponsor Charge Finality
Sponsor charges are based on verified action occurrence and are legally separate from supporter donations. Once the applicable refund buffer has passed and the sponsor charge has been processed, the charge is final. Subsequent donation chargebacks do not affect the finality of sponsor charges.
Fraud Exception
If Act Now determines that systematic fraud caused false action verifications (including but not limited to coordinated fake donations, bot-generated petitions, or manufactured event participation), Act Now reserves the right to:
- Suspend the affected campaign.
- Void pending funding allocations.
- Suspend or permanently ban involved accounts.
- Refer the matter to appropriate authorities.
Sponsor charges already processed remain final unless Act Now determines that the fraud was committed by the campaign charity or participating creator(s), in which case Act Now will work with Stripe to process appropriate reversals.
Payment Processing
All payments on Act Now are processed by Stripe. Act Now does not hold, pool, or redirect funds at any point.
- Donationsflow directly from supporters to the charity's Stripe account.
- Sponsor charges are processed by Stripe based on verified campaign performance. The platform fee (20% standard / 15% volume / 10% founding) is a marketing infrastructure fee for attribution and verification services — it is not a commission on charitable donations.
- Creator compensation is processed by Stripe as payment for marketing services.
Data Handling
Data Minimization
Act Now collects the minimum personal information necessary to operate the Service. We do not store raw IP addresses (only cryptographic hashes). Supporter email addresses collected for petition/signup verification are purged 30 days after verification.
Data Retention
Anonymized action records are retained for 7 years for financial audit purposes (CRA requirement). Account information for creators, charities, and sponsors is retained for the duration of the account plus 7 years after closure.
Your Data Rights
You may request access to, correction of, deletion of, or export of your personal information by contacting privacy@actnowbutton.com. Anonymized records required for financial audits cannot be deleted but will have all personally identifiable information removed. See our Privacy Policy for full details.
Hyperlinking to our Content
The following organizations may link to our Website without prior written approval:
- Government agencies;
- Search engines;
- News organizations;
- Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and
- System wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.
These organizations may link to our home page, to publications or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party's site.
We may consider and approve other link requests from the following types of organizations:
- commonly-known consumer and/or business information sources;
- dot.com community sites;
- associations or other groups representing charities;
- online directory distributors;
- internet portals;
- accounting, law and consulting firms; and
- educational institutions and trade associations.
We will approve link requests from these organizations if we decide that: (a) the link would not make us look unfavorably to ourselves or to our accredited businesses; (b) the organization does not have any negative records with us; (c) the benefit to us from the visibility of the hyperlink compensates the absence of Act Now Button LLC; and (d) the link is in the context of general resource information.
These organizations may link to our home page so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party's site.
If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to Act Now Button LLC. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.
Approved organizations may hyperlink to our Website as follows:
- By use of our corporate name; or
- By use of the uniform resource locator being linked to; or
- By use of any other description of our Website being linked to that makes sense within the context and format of content on the linking party's site.
No use of Act Now Button LLC's logo or other artwork will be allowed for linking absent a trademark license agreement.

Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.
Content Liability
We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights
We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. Removal of links from our website
If you find any link on our Website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly.

Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Canada and the Province of Ontario. You irrevocably submit to the exclusive jurisdiction of the courts in that Province.

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:
- limit or exclude our or your liability for death or personal injury;
- limit or exclude our or your liability for fraud or fraudulent misrepresentation;
- limit any of our or your liabilities in any way that is not permitted under applicable law; or
- exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.
